Van Nistelrooij vindt dat alleen rechters mogen besluiten om een burger af te sluiten van het internet, bijvoorbeeld omdat iemand illegaal muziek heeft gedownload. Zo´n beslissing mag niet worden overgelaten aan de operatoren. Daarnaast vindt hij het onverantwoordelijk dat de lidstaten het hele pakket van maatregelen nu dreigen te gijzelen vanwege dit ene punt.

In Van Nistelrooij's opinion, only judges are allowed to decide to disconnect a citizen from the internet, e.g., because someone has illegally downloaded music. Such a decision can not be left to the operators. Besides this, he thinks it is irresponsible that the member states are threatening to withhold the entire package because of this one point.
