OBJECTIVE: Contact your MEPs and their assistants before July 7th, the date of the vote in IMCO and ITRE committee, to inform them that the "Telecoms Package" amendements are dangerous for users' freedom and harmful to network neutrality

Beyond the July 7th vote, all MEPs will have to take a position on September. The week following July 7th, MEPs will go on vacations, and when they come back on September, they have to vote on plenary. Therefore, it is important to inform them today about the issues they'll have to deal with.

Please use the advice we have here for you and help modify and improve it.

We need YOU to contact urgently, in this order of priority:

1. Members of IMCO committee who have voted against three-strikes approach last April 10th on the resolution about cultural industries in Europe (Bono report):

Ask them to drop or reject the amendments related to Intellectual Property Rights, which are completly unrelated to the Telecoms Package. All the MEPs need to be contacted to prepare themselves to vote against the rapporteurs and draftspersons proposals on September, if such amendements are voted on July 7th.

As today (July 1st 21:00), we know that some so-called compromise amendments (this is an usual term in European Parliament, although there is no compromise at all, these amendments are pushed by pro-three-strikes-approach lobbyists) are discussed behind closed doors and will be tabled for July 7th, although they are not published yet.

General advice

• Always be polite in your communications. MEPs and their assistants are people just like us.
• After sending a short email explaining your concerns in a few words, and containing as an attachment the note of La Quadrature, you can make a phonecall. This may be more useful as it has more impact than an email. (MEP's offices are saturated with mails)
• Make your correspondent understand that you are voting in his area.
• Don't hesitate to offer to send additional information by email, as a follow-up.
• If your correspondent offers to call back but doesn't, don't hesitate to call back. MEPs and their assistants are often very busy.
• If you don't find the answer to a question, note it down and offer you correspondent to call back once you'll have it. Don't hesitate to submit it to us (contact AT laquadrature.net, #laquadrature on irc.freenode.net or discussion list: discut AT laquadrature.net)
• As a rule: have at hand what you need for note taking, to note down the name of your correspondent, information they might give you, a list of blocking points you may work on before calling back, remaining questions, documents you need to send to them, etc.

It has come to my attention that the reform of the “European law on electronic communications” ( the so called “Telecoms Package”) will be debated in the European Parliament next week (7 July). These proposed changes to European telecommunications law will permit the monitoring and blocking of websites and peer-to-peer exchanges by ISPs, in a way that is currently not legally possible. These legal changes will also permit ISPs to sanction users by suspending or terminating Internet access. European Internet users could be blocked from lawful activities by mandatory spyware, in the interests of their "security". The right to use free software for internet access would therefore not be assured anymore. The neutrality of the Internet is also directly attacked, as is the principle that technical intermediaries have no obligation to prior surveillance of contents. Other amendments will de facto enable administrative authorities to obligate ISPs to work with content producers and rights-holders’ private police, including the sending of intimidating messages, with no judicial or regulatory oversight.

The proposed copyright amendments will result in the loss of individual freedom and privacy on the Internet – in breach of fundamental principles of human rights law in Europe.

I am therefore asking you to drop or reject the amendments related to Intellectual Property Rights, which are completley unrelated to the Telecoms Package.

ZIEL: Kontaktiert Eure MdEPs und ihre Assistenten bis zum 7. Juli, an dem im IMCO- und ITRE-Komitee abgestimmt wird. Informiert sie darüber, dass die Änderungsvorschläge zum "Telekommunikationspaket" (engl. Telecoms Package) gefährlich für die Freiheit der Nutzer sind und die Netzneutralität schädigen.

Neben der Abstimmung am 7. Juli müssen alle MdEPs im September eine Position beziehen. Es ist wichtig, sie heute über die Themen zu informieren, mit denen sie sich auseinandersetzen müssen.

Zu Funktion der Berichterstatter: In der Europäischen Union wird ein Berichterstatter vom Europäischen Parlament eingesetzt, um einen Gesetzesentwurf zu untersuchen und am Ende einen Bericht dem Parlament vorzulegen. Oft werden die Berichterstatter von Schattenberichterstattern unterstützt. Im EU-Jargon nennt sich diese Person rapporteur.

Bittet sie, die Änderungsvorschläge abzulehnen, die sich auf IP-Rechte beziehen -- die haben im Telekom-Paket nämlich nichts zu suchen. Wir müssen alle MdEPs kontaktieren, damit sie im September gegen die Änderungen stimmen, falls diese am 7. Juli in den Komitees beschlossen werden.

• Nach einer kurzen Mail, in der Ihr Eure Bedenken kurz schildert und der Ihr die Nachricht von La Quadrature anhängt, könnt Ihr anrufen. Ein Anruf hat auf jeden Fall mehr Einfluss als eine Mail im ohnehin vollen Posteingang.

• Macht Eurem Gesprächspartner klar, dass Ihr aus seinem Wahlkreis kommt. Verschwendet keine Zeit mit Abgeordneten, die nicht aus Eurem Wahlkreis kommen.

• Bietet an, noch eine Mail mit ausführlichen Informationen zu schicken.

• Falls Euch ein Rückruf versprochen wird und nicht erfolgt, ruft selbst wieder an. MdEPs sind sehr beschäftigte Menschen.

• Falls Ihr auf eine Rückfrage keine Antwort wisst, notiert sie und bietet an, später noch einmal anzurufen, sobald Ihr die Antwort habt. Schickt sie auch gerne an uns (contact AT laquadrature.net, #laquadrature on irc.freenode.net or discussion list : discut AT laquadrature.net).

Sehr geehrter Herr ... / Sehr geehrte Frau ...,

Ich habe erfahren, dass die Reform des europäischen Gesetzes zur elektronischen Kommunikation (so genanntes "Telekom Paket") im Europäischen Parlament nächste Woche debattiert wird (7. Juli). Die vorgeschlagenen Änderungen am europäischen Telekommunikationsgesetz erlauben es den Internet Service Providern (ISPs) Websites und Peer-to-Peer Kommunikation zu überwachen und zu blockieren, wie es derzeit nicht legal möglich ist. Diese rechtlichen Änderungen erlauben den ISPs auch, Nutzer zu sanktionieren, indem sie den Internetzugang unterbrechen oder ganz abschalten. Verpflichtende Spionagesoftware kann europäische Internetnutzer davon abhalten, das Internet rechtmäßig zu nutzen - im vermeintlichen Interesse der "Sicherheit". Das Recht, freie Software zum Internetzugang zu benutzen, kann nicht mehr zugesichert werden. Die Netzneutralität wird direkt angegriffen, genau wie der Grundsatz, dass technische Vermittler nicht zur vorherigen Überwachung des Inhalts verpflichet sind. Durch andere Änderungen können Verwaltungsbehörden die ISPs dazu zwingen, mit den Privatpolizeien der Inhaltsanbieter und Rechteinhaber zusammenzuarbeiten. Dies schließt den Versand von einschüchternden Mitteilungen ein, der ohne gerichtliche oder regulative Aufsicht erfolgt.

Die Copyright-Änderungsvorschläge schränken die individuelle Freiheit und Privatshäre im Internet ein - ein Bruch fundamentaler Menschenrechte in Europa.

Ich bitte Sie darum die Änderungsvorschläge abzulehnen, die mit Rechten des geistigen Eigentums in Verbindung stehen. Diese haben absolut keinen Bezug zum Telekom-Paket und dort nichts zu suchen.

Παράδειγμα επιστολής προς τον ευροβουλευτή σας

Γνωρίζω πως στις 7 Ιουλίου θα συζητηθούν στο Ευρωπαϊκό Κοινοβούλιο οι αλλαγές του “European law on electronic communications” (γνωστού και ως “Telecoms Package”). Οι προτεινόμενες αλλαγές θα επιτρέπουν την παρακολούθηση και διακοπή πρόσβασης σε ιστότοπους καθώς και επικοινωνιών ομότιμων δικτύων (p2p) με τρόπους που σήμερα δεν είναι νόμιμοι. Επιπλέον, οι αλλαγές αυτές θα επιτρέπουν στους παρόχους πρόσβασης στο διαδίκτυο να "τιμωρούν" τους χρήστες τους διακόπτοντας προσωρινά ή μόνιμα τη σύνδεσή τους. Με τις αλλαγές αυτές δε θα είναι πια εύκολα δυνατή ή πρόσβαση σε ελεύθερο και ανοικτό λογισμικό ή περιεχόμενο. Επιπλέον οι προτεινόμενες αλλαγές καταργούν την τεχνική ουδετερότητα του διαδικτύου μια και υποχρεώνουν τους παρόχους να παρακολουθούν ενεργά τις επικοινωνίες. Στην πράξη, άλλες από τις προτεινόμενες αλλαγές θα επιτρέψουν σε διοικητικές αρχές να υποχρεώσουν τους παρόχους διαδικτυακών υπηρεσίων να συνεργαστούν με την ιδιωτική αστυνομία των παρόχων περιεχομένου (π.χ. των δισκογραφικών εταιριών και των κινηματογραφικών στούντιο) χωρίς καμιά νομική ή κανονιστική εποπτεία.

Συμπερασματικά, οι προτεινόμενες αλλαγές θα μειώσουν ατομικές ελευθερίες και την προστασία των προσωπικών δεδομένων στο διαδίκτυο, ερχόμενες σε αντίθεση με θεμελιώδεις αρχές των Ευρωπαϊκών ανθρωπίνων δικαιωμάτων.

Για τους λόγους αυτούς σας καλώ ως μέλος της επιτροπής IMCO στη ψηφοφορία της 7ης Ιουλίου να ψηφίσετε κατά των τροπολογιών (compromise amendments) 2, 3, 4, 5 and 7, οι οποίες είναι άλλωστε και άσχετες με το συζητούμενο Telecoms Package. Σας παρακαλώ ενημερώστε με για τις θέσεις σας και τη στάση που σκοπεύετε να τηρήσετε.
