= Executive Summary der aktuellen Situation =

* Über das [[Telecoms_Package|"Telekom-Paket"]] wird am 24. September in der Plenarsitzung des Europaparlaments um 11:30 abgestimmt.
* Einige [[Telecoms_Package_Plenary_Amendments|Änderungsanträge]] enthalten Passagen, die für ein offenes Internet gefährlich sind.
** Einige Änderungsanträge können Nationalstaaten erlauben, eine sogenannte "Graduate Response" Regelung gegen unautorisiertes Filesharing durchzusetzen (Internetsperrungen), was massiv Bürgerrechte beeinträchtigt.
** Die Verwendung des Wortes "lawful content" (rechtmäßiger Inhalt) stellt eine Gefahr für Bürgerrechte und einer nachhaltigen sowie offenen Entwicklung des Internets dar.
* Fortschritte wurden erzielt bei der Neubearbeitung der LIBE-Änderungsanträge (LIBE = Ausschuss für bürgerliche Freiheiten) auf Basis der Analyse des Europäischen Datenschutzbeauftragten.
* Einige sehr sinnvolle und gute Änderungsanträge wurden eingebracht, so unter Anderem das "Bono amendment" beim Trautmann-Report.
* Es bleibt nur noch wenig Zeit, die EU-Abgeordneten über diese Fragen und Konflikte aufzuklären, und ihnen Lesehilfe bei den umfangreichen Änderungsanträgen zu geben. Die wenigsten Abgeordneten hatten bisher mit den Diskussionen zu tun und wissen weitgehend nicht, worüber sie am Mittwoch abstimmen. Hier ist Hilfe notwendig, ihnen die Änderungsanträge zu erklären, und ihre Bedeutung für Bürger- und Verbraucherrechte herauszustellen.

= Detailliertere Argumentation =

== "Graduated Response" ==

Einige Änderungsanträge können Nationalstaaten erlauben, eine sogenannte "Graduate Response"-Regelung gegen unautorisiertes Filesharing durchzusetzen (Internetsperrungen), was massiv Bürgerrechte beeinträchtigt.

* Die Erwähnung von "cooperation" zwischen Internet-Servcie-Providern und der Kulturindustrie über die "Promotion of lawful content" ist sehr vage und unzureichend.
** Eine generelle Information der ISP-Kunden über bestehende Gesetze (z.B. in Form von Newslettern) ist akzeptabel
** Zielgerichtete Mitteilungen an einzelne Kunden und auf Basis der Überwachung des Nutzerverhaltens sind inakzeptabel.
** Es gibt bei dieser "cooperation" keine klare Definition, dass individuelle Benachrichtigungen ausgeschlossen werden 
* LIBE-Änderungsanträge sind nach der Kritik des Europäischen Datenschutzbeauftragten (EPDS) neu bearbeitet worden 
** Der Europäische Datenschutzbeauftragte hatte vorgeschlagen, problematische Änderungsanträge neu zu schreiben. Diesen Hinweisen wurde nachgegangen und die Sprache ist nun weniger gefährlich. Aber es ist immer noch eine Gefahr.

== "Lawful content" ==

Die Verwendung des Wortes "lawful content" (rechtmässiger Inhalt) stellt eine Gefahr für die Bürgerrechte und eine nachhaltigen sowie offenen Entwicklung des Internets dar.

* Wer soll entscheiden, ob Inhalt rechtmässig ist und ob nicht? Wo ist die richterliche Kontrolle darüber?
* Dürfen Behörden ohne Gewaltenkontrolle darüber entscheiden, was rechtmässiger Content ist und was nicht?
* Was ist mit Regelungen wie der Privatkopie oder dem Zitatrecht, bzw. freien Inhalten wie den unter Creative Commons lizensierten Inhalten, bzw. Bottum-Up Innovationen, die die Basis für die Entwicklung einer digitalen Umwelt darstellen?

== Bono amendment ==

Dieser Änderungsantrag garantiert, das dies weiterhin so bleibt, daß keine administrative Autorität oder Behörde rechtliche Entscheidungen fällen kann, die die Freiheit der Konsumenten einschränken könnten, Inhalte im Internet zu erreichen oder selbst bereitzustellen. 
* Die Ausnahmen bei ''"höherer Gewalt"'' und ''"nationalen strafrechtlichen Maßnahmen, die verhängt werden, um die öffentliche Ordnung, die öffentliche Sicherheit, oder die öffentlichen Sitten" aufrecht zu erhalten, '''sind bereits''' im Strafrecht der Mitgliedsstaaten enthalten. Hier wird sich nichts ändern.
* Die Ausnahmen zur ''"Erhaltung der Netzwerk-Integrität und -Neutralität"'' sind legitim, technisch nachweisbar und beschrieben.

* A cut/paste email has *negative* impact: it weakens the content and make it look like spam.

He thinks the compromise amendments (signed by the three majors political groups PSE,EPP/ED and ALDE) are perfectly safe and remove any doubt. ** The EPDS report proved that the initial fears were founded.
** Some improvements were made according to the EDPS recommandations (privacy and IP address related), some other recommandations weren't correctly followed (the first choice of deleting the doubtful dispositions was the only acceptable in most case, in order to truly guarantee that no possibility for surveillance remains)
** If doubts remain, then it's worth voting that amendment 138 and rejecting amendment 34. Amendment 138 just explains the current situation of penal law in the Member States, and that the situation should remain like it is today.

** No administrative authority shall decide what is lawful or unlawful. Only the judicial judge.
** It's a content that is lawful or unlawful, but the user's behaviours. an mp3 music track can be exchanged inside a family circle, within fair use exceptions, private copy, etc.. 
** The content industries shall not threaten the real innovation that built the Internet, digital technologies,  their ecosystem and economy. The never found how to adapt themselves so they helplessly try absurd schemes that are obviously on the way of progress. 
** Authors, creators and artists shall earn money for what content they publish and is appreciated. It's not the question. The question is whether those questions shall parasite or not the Telecoms Package, that regulate the network "tubes".
** No technical intermediary shall be given enforcement powers.

** Our [[Telecoms_Package_Plenary_Voting_List|voting list]] contains many amendments to vote for, including the 138 Bono amendment which we think really clarifies the situation, along with amendments to remove, such as the 34, that is a typical example of parasite amendment from the content industries.
** Our recommendations are mostly in line with the EDPS recommendations, as his report confirmed our previous analysis.
** We want Europe to protect citizens, as stated in the primary objectives of the Telecoms Package. Conversely, these directives must not on the opposite erode individual rights and liberties.
