Situation

  • the plenary vote waill take place on Tuesday September the 23rd.
  • Deadline for tabling amendments for plenary vote is on Wednesday September 17th 12:00


In order to help us in collecting signature for a "magic bullet" amendment against the 3-strikes approach, we need you to contact your Member of European Parliament (MEP).

The following message is to be spread:

  • 3-strikes approach allows the circumventing of judicial autorities in order for some administrative authorities to decide about some punishments limiting Internet users' freedoms.
  • Harbour's compromise amendments open the door to 3-strikes approach as shown by our analysis.
  • The "magic bullet" amendment against 3-strikes approach gets judicial authority back to its role of protector of fundamental freedoms.

Here's the "magic bullet" amendement:

  • Article 1 – point 8 – point e amending Directive 2002/21/EC Article 8 – paragraph 4 – point g
h) applying the principle that no restriction may be imposed on the
rights and freedoms of end users notably in accordance with Article
11 of the Charter of Fundamental Rights of the European Union on
freedom of expression and information, without a prior ruling by the
judicial authorities, except where dictated by force majeure or by
the requirements of preserving network integrity and security, and
subject to national provisions of criminal law imposed for reasons of
public policy, public security or public morality.

This amendment says that when, for example, a private company asks that a citizen's freedoms, and particulary her freedom of speech, should be restricted, because the private company thinks that she's using these freedoms in an excessive manner which is endangering the company's interests, no restriction can be decided without agreement of judicial power (who can act quickly, for example with injunctions).

Limitations to this principle take into account that Members States should be able to take some measures in case of serious infringements (pedophilia, terrorism, manifest racism), as well as the fact that electronic communications service providers should be able to take some measure in case of threat to security of networks and services.

This amendement is therefore proportionnate. It doesn't change European Law. It fullfills the principle of subsidiarity. It guarantees that vague provisions of the Telecoms Package do not lead to tranfert missions from judicial powers to some administrative authorities when being implemented in national laws, while needed exceptions are taken for security purposes.

Afin de nous aider à collecter des signatures pour qu'un amendement crucial contre la riposte graduée soit déposé, nous avons besoin que vous contactiez votre eurodéputé.

Le message à faire passer est le suivant :

  • la riposte graduée permet de contourner l'autorité judiciaire pour que des autorités administratives décident de sanctions limitant les libertés des internautes ;
  • les amendements de compromis de Harbour laissent la porte ouverte à la riposte graduée comme le montre notre analyse ;
  • l'amendement crucial contre la riposte graduée rétablit la position de l'autorité judiciaire comme gardien des libertés fondamentales.

Afin de nous aider à collecter des signatures pour l'amendement "autorité judiciaire" contre la riposte graduée, nous avons besoin que vous contactiez votre député européen:

Voici l'amendement

Cet amendement précise que lorsque, par exemple, une entreprise demande que les libertés d'un citoyen, et tout particulièrement sa liberté d'expression, soient restreintes, car l'entreprise estime qu'il les utilise excessivement et porte atteinte à ses interêts, aucune restriction ne puisse être prise sans accord de l'autorité judiciaire (qui peut agir très vite par exemple en référé).

Les limitations posées à ce principe dans l'amendement prennent en compte la possibilité pour les États membres de prendre des mesures préventives en cas d'infractions graves (pédophilie, terrorisme, racisme manifeste), ainsi que le fait que les opérateurs réseaux doivent pouvoir prendre les mesures nécessaires en cas de menaces pour la sécurité du réseau et des services.

Cet amendement est donc proportionné. Il ne change pas l'état du droit européen. Il respecte le principe de subsidiarité. Il constitue une garantie que les dispositions floues du paquet télécom ne conduiront au transfert de missions de l'autorité judiciaire à des autorités administratives lors de la transposition par les États membres, tout en prévoyant les exceptions nécessaires à la sécurité.
