I think that this amendment has no legal impact. This is indeed the opinion of the European Commission, which, through its spokesman, said it was a simple reminder, a general principle which does not preclude the possibility for each State to acquire the best possible means to fight against downloading. However, this amendment creates an effect of interference and opens a possibility of manipulation. For the sake of clarity, we want it therefore to be withdrawn. We have good reason to believe that will be. The distinction, made by many speakers, between the concept of freedom and the law is crucial. If it is enriching and convenient, and even necessary, to have access to the Internet, it can be discussed that is a fundamental freedom, as Mrs. Tasca has very finely said. In any case, it would be a freedom bounded by other freedoms, a right to link up with other rights. I recall that the proposed bill seeks to suspend access to the Internet at home, which does not prevent to go to one's neighbor or to any cybercafe to carry out formalities or obligations of everyday life. It's not like if you are deprived of your driver's license, in which case you can no more drive your car nor any other. Therefore do not affect the same level to freedom of movement and to freedom of surfing the net. Je pense que cet amendement n'a pas de portée juridique. C'est d'ailleurs l'avis de la Commission européenne, qui, par la voix de son porte-parole, a dit qu'il s'agissait d'un simple rappel, d'un principe général ne faisant nullement obstacle à la possibilité pour chaque État de se doter des meilleurs moyens possibles de lutter contre le téléchargement. Cela étant, cet amendement crée un effet de brouillage et ouvre une possibilité de manipulation. Dans un souci de clarté, nous souhaitons donc qu'il soit retiré. Nous avons de bonnes raisons de croire qu'il le sera. La distinction, par de nombreux intervenants, de la notion de liberté et du droit est cruciale. S'il est enrichissant et commode, voire nécessaire, d'avoir accès à internet, on peut discuter du fait qu'il s'agisse d'une liberté fondamentale, comme Mme Tasca l'a très finement souligné. En tout cas, ce serait une liberté bornée par d'autres libertés, un droit devant s'articuler avec d'autres droits. Je le rappelle, le projet de loi vise à suspendre l'accès à internet chez soi, ce qui n'interdit nullement d'aller chez son voisin ou dans n'importe quel cybercafé pour procéder à des formalités ou aux obligations de la vie courante. Ce n'est pas comme si l'on vous privait de votre permis de conduire, auquel cas vous ne pourriez plus conduire votre voiture ni aucune autre. Ne mettons donc pas sur le même plan une liberté comme celle d'aller et venir et la liberté de naviguer sur le net.
