Dans la partie VI du questionnaire, la Commission demande si « le cadre juridique actuel est assez clair pour permettre l'implication suffisante des intermédiaires (comme les fournisseurs d'accès Internet, les régies publicitaires, les moyens de paiement en ligne, les registaires de noms de domaines) dans la prévention des violations en ligne au droit d'auteur dans un cadre commercial » et « quelles mesures seraient utiles pour favoriser la coopération de ces intermédiaires ». On retrouve ici la volonté de faciliter l'engagement de la responsabilité des intermédiaires techniques qui était au cœur de la loi SOPA aux États-Unis ou de l'accord ACTA. Mais les formulations employées par la Commission font aussi écho au concept « d'auto-régulation des plateformes » qui est poussé actuellement par la France au niveau européen et qui peut conduire à la mise en place de nouvelles formes de police privée du droit d'auteur.

In section VI of the public consultation, the Commission asks whether “the current legal framework [is] clear enough to allow for sufficient involvement of intermediaries (such as Internet service providers, advertising brokers, payment service providers, domain name registrars, etc.) in inhibiting online copyright infringements with a commercial purpose” and “If not, what measures would be useful to foster the cooperation of intermediaries?". The desire to involve and make responsible technical intermediaries, which was also at the heart of SOPA and ACTA, can be seen clearly here.
  
De telles mesures constituent une fuite en avant dans la spirale répressive qui caractérise l'évolution du droit d'auteur depuis des années. Elles sont également de nature à porter atteinte à la liberté d'expression en ligne, ainsi qu'à remettre en cause les garanties essentielles des droits des citoyens qui nécessitent l'intervention d'un juge au terme d'une procédure équitable. Les principes applicables à la responsabilité des intermédiaires techniques sont fixés par la directive 2000/31/CE relative au commerce électronique, ainsi que par la jurisprudence des juridictions européennes. La révision de la directive sur le droit d'auteur ne doit pas conduire à fragiliser le statut de ces acteurs essentiels.

This reflects the repressive tendency that has characterised the evolution of copyright legislation for years. It will affect freedom of expression online, as well as jeopardising essential guarantees of citizens' rights which require the intervention of a judge and a fair trial. The principles applicable to the liability of technical intermediaries are regulated by Directive 2000/31/EC on electronic commerce, and have been laid out by jurisprudence in several european courts. The revision of the Directive on copyright should not weaken their status.
